Privacy Policy

Turboevict.com LLC (“Turboevict) respects the privacy of visitors to, and users of, Turboevict.com (the "Site").  The purpose of this Privacy Policy is to inform you about the types of information Turboevict gathers about you when you visit or use the Site and the Service, how Turboevict may use that information, and whether and how Turboevict discloses it to third parties.  By visiting the Site and using the Service, you are consenting to the terms of this Privacy Policy.   Turboevict reserves the right to change this Privacy Policy at any time by posting a new privacy policy at this location.  Therefore, you are responsible for periodically checking the Privacy Policy for changes.

Please read this Privacy Policy carefully and note that it applies only to the Site, and not to third party websites to which the Site contains links or to companies to which Turboevict may refer you, which may also collect information about you.  Turboevict does not control sites that are operated by others and is not responsible for the information practices of those sites. 

Capitalized terms not defined herein shall have the meaning ascribed to them in the Terms of Service.

1. Information Collection and Use

Personal Information

Turboevict will not collect any personally identifiable information about you, such as your name, address, telephone number or e-mail address, unless you provide it to us voluntarily.  

In order to use the Site, you must establish a customer account, which requires the collection of certain information as more specifically set forth in the Terms of Service.  Except as expressly set out in this Privacy Policy, or as disclosed when you sign up for, or otherwise provide information to use, or participate in a feature on the Site, or where required by law, or where necessary to provide services to you (e.g., to process payment information), Turboevict will not disclose any personally identifiable information to a third party without your express prior authorization, nor will Turboevict use that information for any purpose other than to provide the applicable feature.  For avoidance of doubt, disclosure of information provided by you will be made to the attorney referred to by Turboevict as set out in the Terms of Service.

Turboevict may use the information you provide (including, without limitation, the name and address of tenant(s)) to contact you, to service your Customer account or for other administrative purposes.  Turboevict may also access and use such information to resolve disputes, to troubleshoot problems, to enforce the Terms of Service or for marketing purposes (including, without limitation, the marketing purposes described below).  In addition, the Site may use certain transaction details to automate and streamline the applicable transaction by checking for electronic data compliance, and transferring data from previous forms to those of the current transaction.

From time to time, Turboevict may also use or disclose to its marketing partners, advertisers and other businesses your name and/or email address, which marketing partners, advertisers and/or other businesses may choose to provide you with marketing and other communications.

Non-Personal Information

In some cases, when you use the Site, we may collect information that is non-personally identifiable or information that, by itself, cannot be used to identify or contact you.  Examples of this type of information include the type of Internet browser or computer operating system you use, demographic information (profession, zip code, etc.), gender, the date and time you visited the Site, the pages you accessed, the name of the website from which you linked to the Site and other anonymous data involving your use of the Site. Turboevict uses this information to gather broad demographic information for aggregate use.  This information is not linked to any personally identifiable information.

Data Retention

Turboevict will retain your information until thirty (30) days after the date on which an eviction proceeding is completed (as described in the Terms of Service), at which time, Turboevict will have the right to purge such information from its database(s).  Turboevict may (but will have no obligation to) retain your information for as long as your Customer account is active or as needed to provide you with services.  Turboevict may also retain and use your information as necessary to comply with its legal obligations.  Turboevict will have no obligation to retain hard copies of Eviction Data or other information related to an eviction proceeding.

Cookies

Turboevict may use browser-based cookies and/or flash shared objects, which are small text files placed on your computer's hard drive, as well as web beacons (also known as pixel tags), which are electronic images embedded into a web page, on the Site. Cookies, shared objects and web beacons are used for record keeping, to track your movements when you visit the Site and to help Turboevict and authorized third party vendors to determine what type of information to present to you. The use of cookies, shared objects and web beacons is an industry standard practice used at most websites and can enhance a user’s experience on a website.  Turboevict’s cookies, shared objects and web beacons do not contain personally identifiable information, and do not damage or alter your system files. Although you can choose not to accept cookies through a setting on most browsers (which can also be set to  notify you each time a cookie is set), if you choose to refuse cookies, you may not be able to use all of the features of the Site.

2. Email Communications

There may be times when you will have the opportunity to subscribe to an email list or electronic newsletter that will send information about the Site and/or the Service.  Even if you choose to become a subscriber, you will have the option to change your preferences and opt-out of receiving those communications.  You may request at any time that Turboevict not email you in the future by clicking the “unsubscribe” link which is included at the bottom of any promotional email that you receive from Turboevict, or by contacting Turboevict at info@Turboevict.com.  If you unsubscribe, Turboevict will make reasonable efforts to discontinue these email communications as soon as practicable.  For avoidance of doubt, the “opt out” described in this section applies only to promotional communications.  

3. Security

The Site has security measures in place to protect against the loss, misuse and alteration of the information under Turboevict’s control.   Access to the Site is password protected and sensitive data (such as credit card information) is protected by SSL encryption when it is exchanged between your web browser and the Site.  However, as it is not possible to guarantee the security or integrity of information you disclose online, Turboevict urges you to take every precaution to protect your personal data when you are on the Internet.  A user should never share his or her password with anyone and should select a password that is difficult to guess.  Turboevict is not responsible for non-compliance with recommended security practices.

Because no physical or electronic security is impenetrable, by using the Site or emailing information to Turboevict, you agree to assume all risk in connection with that information.

4. Agents and Service Providers

Turboevict may use third parties to provide certain services or to assist Turboevict in responding to inquiries or request from you, including credit card processing services. These third parties do not share, store or use your personally identifiable information for any purpose other than the purpose for which their services have been retained.  In addition, if you sign up through the Site for a service provided by a third party under contract with Turboevict, Turboevict will share only the minimum information necessary for the third party to provide the applicable service.

5. Parties to Whom Turboevict Discloses Information

Turboevict does not disclose your personal information to anyone without your consent or as otherwise set out in this Privacy Policy, except in the following situations:

1. To comply with a validly issued and enforceable subpoena or summons, a court order, or as requested by other government or law enforcement authority.
 
2. To investigate network abuse or a violation of the Terms of Service or other published guidelines.
 
3. As a part of any actual or threatened legal proceedings or alternative dispute resolution proceedings either initiated by or against Turboevict.
 
4. If you engage in (or are reasonably suspected of engaging in) any illegal activities.

Turboevict also reserves the right to report any suspected illegal activity to law enforcement for investigation or prosecution.

7. Miscellaneous
